Definitions

Resident is defined as any occupant of a home in Coppermill.

Lessee (shall be referred to by Tenant) is defined as an occupant who is leasing from an Owner of record.

Visitor is defined as a non-resident.

Owner is defined as a person(s) who legally owns a Coppermill home.

Management is defined as the current management company of the Coppermill Property Owners Association, or any of its agents.  Management address is located at the bottom of this page.

Association is defined as the Coppermill Property Owners Association (CPOA) or any of its agents.


General Provisions

Parking Regulations

1.                  All vehicles of residents must display a CPOA sticker on the back of the rear view mirror which can be viewed through the windshield.

2.                  As per Fairfax County regulation each townhouse has two and three-tenths (2.3) parking spaces per townhouse with each garage townhouse allocated two (2) spaces: the garage and the driveway.

3.                  In Coppermill the garage and the driveway are the only “reserved” parking spaces per townhouse.

4.                  Remaining parking spaces are utilized on a first-come first-served basis. We currently have 149 common spaces to be shared by the Residents of our 218 townhouses.

5.                  A vehicle parked in a common parking space with or without CPOA stickers shall not be parked in the same space longer than 48 hours.

6.                  Special exceptions will be made to the 48 hour rule. For example, the residents of a townhouse have more than two cars and want to go on a vacation. In this instance the additional vehicles may be parked in common parking spaces for up to three weeks with out being moved. Special exceptions must be reported to Management or the vehicles will be subject to towing.

                                                a.   Send notice to the Management Company above that you will be away and will not be able to move your extra vehicle(s) during that time. Include the information listed below. Reminder: This is only necessary for vehicles parked in the common area                                                   spaces.  Each exemption is for a maximum of three weeks (See Rule 7). Notice should be sent no more than two weeks prior to trip. Exemptions can only be granted to vehicles bearing a CPOA parking sticker.

1.                  Under no circumstances can a vehicle of a resident be left in the same common parking space for more than three weeks without being moved.

2.                  Vehicles parked on Coppermill property must display current license plates, county stickers, and inspection stickers. All Residents have 30 days from the implementation of this parking policy to comply. Violation of this rule shall result in the posting of a notice on the vehicle directing the removal of the vehicle or the correction of the violation within two (2) days. All actions shall be coordinated with the Fairfax County Police Department in accordance with the applicable requirements of the Code of Virginia as amended.

3.                  Parking areas shall be used solely for the parking of approved vehicles as defined herein. Vehicles may be parked only in designated parking spaces and areas. Vehicles must be parked within the spaces provided and in such a manner as not to obstruct or reduce other parking spaces or impede access.

4.                  Parking of recreational vehicles, campers, trailers, boats, etc. is prohibited on Coppermill property. Recreational vehicles, camper, trailers, boats, etc. may be parked in driveways for loading and unloading purposes.

5.                  Oversize and commercial vehicles are prohibited from parking within the community of Coppermill.

Oversize vehicles are defined as follows:

a.       Any pickup or van with dual wheel rear axle.

b.      Any pickup or van exceeding three-quarters of a ton.

c.       Moving vans, step vans, tractor-trailers, wreckers, hearses, limousines, busses, travel trailers, house trailers, utility trailers, or any other oversize recreational vehicles, commercial trucks, and vans.

Commercial vehicles, defined as:

a.       Any “for hire” vehicle or vehicle that has commercial signs, lettering, advertising, and/or commercial equipment visible from or on the exterior. Commercial equipment includes, without limitation, exterior racks (except luggage, ski, bicycle, or boat roof racks); pipes, and ladders; interior equipment such as supplies, propane, pesticides, fuel tanks, cabling; unsecured tools or supplies indicative of commercial use or inconsistent with the Association’s aesthetic appearance, except for brief deliveries of passengers or merchandise, or while performing work or services for an Owner, Resident or for the Association.

12.        On a case-by-case basis, commercial vehicles of the types mentioned above may be allowed to park on Coppermill property according to individual application to the CPOA Board of Directors. See attachment A for instructions for submitting an application.

Parking Stickers

13.              To receive a CPOA parking sticker all residents must register their vehicles with the Management.

14.              Management will issue Residents a CPOA parking sticker for each legally licensed and registered vehicle on file. This sticker must be applied to the back of the rear view mirror of each registered vehicle.

15.              Registration forms and instructions for registering vehicles with Management will be included in association documents provided at settlement. Management will mail registration forms to tenants and new vehicle owners when the forms are requested.

16.              Residents have 30 days after they move into Coppermill to register their vehicles.

17.              Vehicles purchased by residents must be registered with Management within 30 days after being brought onto the associations’ common property.

18.              All vehicles must be legally licensed in order to be issued a CPOA parking sticker. Vehicles must have current Virginia license tags, up to date inspection and Fairfax County stickers and be registered to a Coppermill address in order to be eligible for a CPOA parking sticker. The exceptions to the registration eligibility are vehicles belonging to military personnel and diplomats.

19.              Military personnel and diplomats living in Coppermill can register their vehicles by showing their military or diplomatic IDs and providing documentation that proves the vehicles are legally registered and licensed

20.              Nonresident Owners have the status of Visitor, and because they do not live in the community, will not be issued parking stickers.

 

Vehicle Operations

21.              All vehicles operated on Coppermill streets must be operated by a person holding a valid driver’s license or permit.

22.              No unlicensed vehicles, including but not limited to, motorized bicycles, motorcycles, mini-bikes, go-karts, etc., shall be operated on or parked on any area of Coppermill.

23.              All motor vehicles shall not exceed the speed limit of fourteen (14) miles per hour while operating in the community of Coppermill.

24.              Operation of any motorized vehicle in the common area shall be restricted to the paved roadways only.

25.              Operation of any motor vehicle in violation of Titles 46.2 or 18.2 of the 1950 Code of Virginia, as amended, is prohibited. Consent is hereby given by the Board of Directors to all appropriate law enforcement officer(s) who are hereby empowered to enforce all motor vehicle laws on the streets and common areas of Coppermill.

26.              The unnecessary sounding of vehicle horns, playing radios, CDs, or tape players at excessive volume, or other excessively loud sound producing devices is prohibited.

27.              The screeching of tires and the “revving” of vehicle engines is prohibited.

 

Maintenance of Vehicles

28.              All vehicles parked on common areas must be maintained in an acceptable state of repair to meet the following conditions:

a)                                                                                                      Powered vehicles must be maintained in an operating condition.

b)     Tires supporting vehicles on common areas must be inflated at all times to within 10 PSI of the manufacturer’s recommended pressure so that vehicles can be moved in the event of an emergency.

29.              Minor repairs begun on vehicles by Residents of Coppermill or their assigned agent while on any common area must be completed within 48 hours from the starting date of the repair. Major repairs (including, but not limited to, engine, transmission and rear end overhauls) are prohibited in the community of Coppermill. No vehicle may be left unattended on jacks, ramps, or any other devices at any time.

30.              The community of Coppermill may not be used to repair visitor’s vehicles on a regular basis; only emergency repairs are permitted.

31.              The owner of a vehicle is liable for any damage sustained to the common areas as a result of any repair of his/her vehicle or operation of the vehicle on common areas.

32.              Leaks of oil, grease, or any other chemical, residual substance, from holding tanks of vehicles of any type as a result of repair, maintenance, or carelessness is not permitted on common areas.

33.              The dumping of motor oil, antifreeze, and other petroleum products into the storm sewers or on common property is prohibited.


Enforcement

Notice of Violation – Any Resident whose vehicle is not in compliance with this Resolution shall be notified by Management of the violation by the posting of a notice on the vehicle, or in writing. If the vehicle is not brought into compliance within 48 hours, it will be subject to removal by towing. A record of such action shall be entered in the Association’s record by Management.

Conditions Warranting Immediate Towing Without Notice – Any vehicle shall be subject to immediate removal without notification by a licensed towing company contacted by a Board Member or Management when parked in any of the following manners:

34.              Parked in such a manner as to obstruct entry or exit into or out of another parking space;

35.              Parked in a posted or designated fire lane or within 15 feet of a fire hydrant;

36.              Occupying more than one (1) parking space;

37.              Parking perpendicular to a marked parking space or on a grassy area or sidewalk;

38.              Impeding access to mailboxes;

39.              Or in any other way constituting a safety hazard.

40.              Vehicles sticking out in the road from driveway with two tires on road.

All reasonable attempts will be made to identify the owner of the vehicle in violation of these regulations, by appointed members of the Parking Committee or Board Member. If the owner of the vehicle cannot be contacted within a timeframe deemed reasonable, the vehicle will be subject to immediate towing. Such towing shall be authorized by no less than 2 (two) of the appointed members of the Parking Committee or Board.

Additional Remedies – The Board reserves the right to exercise all other powers and remedies provided by the Association’s governing documents or the laws of Virginia and the County of Fairfax including, but not limited to, the imposition of monetary charges.

Persons Authorized to Tow – Only a member of the Board of Directors, Management, or any Board-designated person may authorize towing of any vehicle with the exception of vehicles that are parked illegally along the yellow curbs and at the emergency turn a rounds. To report a parking violation, residents should contact a Board Member or Management. All expenses for retrieving the vehicle shall be the responsibility of the owner or operator of the vehicle in violation.


Liability

Association – The Association assumes no responsibility for any damage to or theft from any vehicle parked, operated on, or towed from Coppermill Association property. All costs of towing and impoundment shall be the sole responsibility of the vehicle’s owner or operator.

Vehicle Owner – The owner of a vehicle in violation of this Resolution shall be held liable for any expenses incurred by the Association as a result of any damage done to the common area by the use, repair, maintenance or towing of a vehicle.
